Georgia DUI Blood Test
If you submitted to a blood test that means samples of your blood were taken to measure the amount of alcohol in your blood, shortly after you were pulled over by police while driving.
These tests are generally not given at the scene, since only a qualified person can administer the test. Blood tests are quite accurate and can measure traces of any substance a person has ingested.
In the scientific and medical community, blood tests are highly regarded as accurate. Therefore, if you submit to a blood test you are taking it at your own risk. Attorneys can argue both breath and urine tests as these have flaws. Our attorneys would have a much harder time attacking evidence from a blood test.
Where our attorneys can find strength to dispute the blood test is in who actually administered the test. Every state has differing regulations as to who is qualified to give a blood test, how these tests are taken, transported, analyzed, etc. Your experienced attorney will know if the correct procedures were followed and if not, will fight the evidence against you.
If a blood test was given by an unqualified person or if they improperly administered blood test, this would be grounds for disputing the evidence. Or even a tainted blood sample would allow the reliability of the blood test to be challenged in court. Remember that even if a blood test is given by a qualified person, errors can still occur!
If you submitted to a blood test and failed, you should not give up hope.
