Georgia DUI Alphabet Test
The state of Georgia has only approved three field sobriety tests: the HGN, the Walk and Turn and the One Leg Stand. There are many other tests that police officers use to determine if one has been drinking and driving. These "tests" are non-validated field sobriety tests -and one of them is the Georgia Alphabet Test. Your DUI defense attorney will find out whether you have received such a non-validated test and will fight for your rights.
A court must decide whether or not the test administered to you has any scientific evidence of alcohol consumption above the legal limit. Remember, it is your attorney's job to convince the courts that these non-validated tests are not scientific fact!
While there are many different methods of the Alphabet Test, most involve an officer instructing you to say the alphabet. Although they may ask you to recite it backwards! The officer does not want you to "sing" the alphabet, but simply state the letters in order. They may ask you to start at letter G and work your way to letter X - the possibilities are almost endless.
Of all the problems associated with this "test", the most important lies in the fact that the test cannot be validated and cannot accurately separate sober individuals from those who are under the influence. And when was the last time you actually had to recite the alphabet -first grade? In America, we come from different backgrounds and many of us are not native to the English language, which creates an issue when asked to recite the alphabet in a different way. Of course, you may just be nervous when a light is being shined in your face!
For all these reasons and more, the Alphabet Test does not have any standardization in scoring this exercise for DUI purposes.
