What to Expect if You're Arrested

Being arrested is a scary and confusing process. Here's what may happen following an arrest:

After an arrest, police generally process a suspect, which is also known as "booking". During this time, your personal information will be recorded, including the information regarding the crime. Police will run a background check to determine if there are any outstanding warrants or any prior convictions.

Your fingerprints will then be taken and you will receive a mug shot. Before placing you in a holding cell, you will be searched for weapons. You will then be placed in a holding cell or local jail.

Bail, Bail Bonds and Bail Agencies

Bail is a set amount of money determined by a judge, allowing your release from jail. A judge may determine the amount of money by your criminal history, the seriousness of your DUI offense and your ties to the community. Under these terms, you agree to pay all set amount of money and to appear back in court for all scheduled court appearances. This may include arraignment, preliminary hearing, pre-trail motion and the trial if necessary.

Bail can be "posted" for you by anyone. If friends and family cannot afford to post bail for you, a bail bondsman or bail agency may help.

A bond is a written contract that states the amount will must be paid if you fail to appear in court. A bail agency or bondsman usually wants collateral up front and typically charges fees for their services.
