Georgia DUI Breath Test

As in many other states, Georgia utilizes what is called a breathalyzer test if a police officer suspects someone of drinking and driving. A breathalyzer measures a person's blood alcohol level by determining the amount of ethanol on your breath. Ethanol is a key ingredient in alcohol and the test can pick up on this.

When you have alcohol on your breath, it is the same as the amount of ethanol in your system. Police officers widely use this test and it is given shortly after you are suspect of a DUI.

Under Georgia's implied consent law, you are agreeing to chemical testing when you driving a motor vehicle. The implied consent law basically means that if you are driving you are "consenting" to DUI testing upon being suspected of DUI.

In the state of Georgia, you are required to submit to a breathalyzer is required by a police officer. If you refuse, you could lose your license or receive other penalties.

However, if you agree to take the breathalyzer and you fail by going over Georgia's legal limit, you could be subject to similar penalties. But the breathalyzer is not exactly the most reliable machine. They have many flaws such as the ability to read alcohol if you've taken cough syrup or were chewing gum.

But their flaws are your attorney's strengths. Your attorney can challenge the breathalyzer in two ways. First, they can state the flaws of the machine. Second, they can question the arresting officer's ability to administer and read the test results correctly. Many police officers do not have adequate training and therefore use the breathalyzer machines improperly.

It is also wise to consult with your lawyer. Your lawyer should be experienced, dedicated and well educated in the varying complexities of DUI laws.
